Asbestos & Mesothelioma Lawsuits in Charleston and Kanawha County

Kanawha County has seen its fair share of asbestos and mesothelioma cases. In 2002, a trial in Charleston resulted in the jury finding Dow Chemical Company’s Union Carbide being found liable for thousands of asbestos-related illnesses and deaths. 8,000 plaintiffs were originally involved in the case against 250 named corporations. Most of these cases were settled or resulted in dismissed claims, but 2,000 plaintiffs continued with the case against Union Carbide. The plaintiffs alleged that they were exposed to asbestos in insulation in Union Carbide’s chemical plants or by products like joint compound manufactured by the company. The jury concluded that the company should compensate victims for exposure in their plants from 1945 to 1980 and by exposure from their products from 1964 to 1972. After the jury found Union Carbide liable, a series of hearings were scheduled to assess damages in individual cases.

Also in 2002, a Kanawha County jury returned a $6.5 million verdict in favor of the survivors of a man who died at age 52 from mesothelioma after inhaling asbestos dust as a young child. The man experienced secondhand exposure of asbestos dust. His father worked as a pipe coverer at the DuPonte Belle, West Virginia plant.

In 2014, a Charleston Circuit Court jury returned a verdict against John Crane, Inc. after finding that products that contained asbestos caused a former pipefitter to contract mesothelioma. The man had worked as a pipefitter for a local union for 41 years before eventually retiring. During this time, he worked with gaskets produced by the manufacturer. The jury found John Crane negligent by failing to warn the man of the dangers of its products and that the gaskets were defective. Before the verdict, the amount of damages had already been stipulated by the parties.
