Sample South Carolina Mesothelioma & Asbestos Verdicts

After finding that a former power plant employee’s fatal mesothelioma was caused by asbestos in valves made by the defendant, an Anderson County jury awarded $5.1 million to his widow in 2019. The jury found that the manufacturer was negligent and breached its implied warranty. The widow received $3 million in compensatory damages and $2.125 million in punitive damages. The man had worked in utilities and instrumentation, during which time he inhaled asbestos dust and fibers from various materials that contained asbestos and were manufactured by the defendants.

A Spartanburg County jury in 2015 awarded the family of a man who died from mesothelioma in 2015 $14 million after finding that the man’s work as a contractor who maintained and repaired the company’s machinery caused him to be exposed to asbestos and eventually die from mesothelioma. The man worked at a Celanese polyester plant in Spartanburg from 1971 to 1980 where he was regularly exposed to asbestos. He was diagnosed with mesothelioma in 2013 and died from the disease a year later. The jury found the company negligent in causing the man’s mesothelioma. The company appealed the decision, but the appellate court upheld the verdict.
